The widow of a driver killed on a ‘Smart Motorway’ is to sue Highways England for corporate manslaughter after her husband and fellow passenger both died in a collision with a lorry. Their vehicle had pulled over, after a minor collision on the M1, however the hard shoulder had been transformed into a live lane.

The case will look to prove that Highways England failed to provide adequate protection in removing the hard shoulder and is a breach of the company’s duty of care.
