A report from Aviva has claimed that freezing personal injury lawyers and claims farmers out of the motor market would save up to £1.5bn in unnecessary costs and lead to lower premiums for drivers. The report calls on accident victims to go direct to their insurer, an idea which has been dismissed by the Association of Personal Injury Lawyers. Its chief executive Deborah Evans comments: “The idea that an injured person could rely on the good nature of the guilty party’s insurer to provide proper compensation cannot possibly be taken seriously”. Insurers “are not naturally known for their willingness to pay out, or always to pay out fairly”, Ms Evans said. She added that the inherent conflict of interest would leave motorists vulnerable to low settlements. She also notes that research from the FSA has found that, on average, injured parties received almost 275% more than they had been offered by their insurer if they took their claim to the courts.
