The government are believed to be considering the closure of a legal loophole that allows drivers to use their mobile phones to film or take photos while driving. This year alone, several cases have used the loophole to escape prosecution.
At present, under UK law it is illegal to call or text on hand held phones, however the wording of the legislation currently states it is illegal to use a device ‘which performs an interactive communication’ while driving. Drivers have therefore said that they were not using their phones ‘to communicate’ and avoided prosecution.
The government have said that it will reform the legislation by ‘next spring’ as the current rules have not moved with the advancements in smartphones.
